The establishment of Human Rights Department within the Ministry of Internal Affairs (MIA) is an important development in terms of building quality control mechanism in police system. The department is tasked to monitor the investigations of crimes of domestic violence and violence against women, crimes committed by or against juveniles, hate crimes and crimes of trafficking.
In the Prosecutor's Office (PO) Department of Supervision Over Prosecutorial Activities and Strategic Planning assesses prosecutorial activities through studying criminal case files and monitoring performance of prosecutors, including on juvenile cases. Performance of specialized prosecutors on processing diversion and mediation cases is carried out by the Analytical Division of the Department. There is one employee within the division specifically assigned to monitor juvenile cases processed by specialized prosecutors. Case files are checked against pre-defined criteria (compliance with deadlines, average time spent on processing the case, etc.) and rules contained in the manual for specialized prosecutors which provide guidance how to handle Juvenile cases.
Ultimate goal of the monitoring in both systems is to identify shortcomings in practice and address them through issuing corresponding guidelines/recommendations. Monitoring reports with detailed generalized analysis of revealed trends and corresponding recommendations should be followed by capacity building activities for specialized prosecutors and investigators.
While some elements of quality assurance are put in place within the MIA and the PO, they are in initial phase of development, are not yet institutionalized and function in an ad hoc manner. There are no methodologies and relevant tools to guide quality monitoring and the systems lack the required capacity to develop them. ÂAgainst this background, there is a need to strengthen quality assurance mechanisms to provide guidance and support to investigators and prosecutors and identify areas for improvement.
UNICEF supports the MIA and the PO in strengthening quality assurance mechanisms for the investigation of crimes committed by and towards juveniles. UNICEF therefore seeks to engage a local expert with the objective to provide technical expertise to the MIA and CPO in conducting needs-assessments and in developing a concept, as well as all necessary instruments for strengthening quality assurance mechanisms.
The overall objective of the consultancy is to provide technical expertise to the MIA and the PO in conducting needs-assessments and in developing a concept, as well as all necessary instruments for strengthening quality assurance mechanisms in the police and prosecutorial systems.
The specific tasks of the consultancy are:
The consultancy will be conducted during 2018 throughout a period of 4 months. The consultancy entails intensive work from home and in working meetings with a broad variety of stakeholders. UNICEF will support the contractor in establishing contact and meetings with all relevant partners and stakeholders.
The contractor will work under the joint supervision of UNICEF Georgia's Child Protection Specialist and Child Protection Officer.
The contractor's performance will be evaluated against the following criteria: timeliness, responsibility, initiative and quality of the products delivered.
The consultancy fee and possible travel costs will be negotiated between UNICEF and the contractor based on an offer from the contractor. The consultancy fee will be paid to the contractor in one or several instalments upon submission and approval of relevant reports and quality deliverables.
The contract may be terminated by either party before its expiry date by giving a 14 days notice in writing to the other party. However, in the event of termination on the ground of misconduct, UNICEF will be entitled to terminate the contract immediately, without earlier notice. In case of early termination of the contract, the Contractor will be compensated on a pro-rata basis for no more than the actual amount of work completed to the satisfaction of UNICEF.
